Woman Who Beat Cancer Facing Eviction From Rent-Stabilized Apartment

CLAIMS SHE HAD NO CHOICE IN ORDER TO MAKE ENDS MEET. CBS 2’S ERIN LOGAN HAS THE STORY FROM GREENWICH VILLAGE. I HAVE NO PLACE TO GO. [ CRYING ] SO, UM, I’M JUST SITTING HERE WADING FOR THE MARSHALS TO KNOCK ON MY DOOR AND TAKE EVERYTHING AND THROW ME IN THE STREET. [ CRYING ] Reporter: FOR MORE THAN 40 YEARS, THE 70-YEAR-OLD HAS BEEN CALLING THIS GREENWICH VILLAGE APARTMENT HOME. BUT SINCE 2012, HER LANDLORD HAS WANTED HER GONE. I DID EVERYTHING MORALLY AND TRUSTWORTHY THAT THE BUILDING ASKED ME FOR. Reporter: BUT ON TUESDAY, 3 OUT OF 5 JUDGES IN A MANHATTAN APPELLATE COURT DISAGREED, SIDING WITH HER LANDLORD THAT LIP ITS WAS MAKING A BIG PROFIT OVER AN 18-MONTH PERIOD. LIPITZ WAS DIAGNOSED WITH CANCER IN 2010 AND SAYS SHE COULDN’T EVEN AFFORD HER SUBSIDIZED RENT SO SHE NEEDED HELP. A FRIEND TOLD HER ABOUT AIRBNB WHICH WAS FAIRLY NEW AT THE TIME. I FILLED OUT WHO WAS STAYING HERE, HOW LONG THEY WERE STAYING HERE, I DID NOTHING WRONG. Reporter: HER ATTORNEY SAYS SHE IS ACCUSED OF PROFITING ABOUT $12,000 IN EXCESS OF HER $21,000 A YEAR RENT FOR HER ONE- BEDROOM APARTMENT. MY PROFIT WAS $3,000. Reporter: THE ATTORNEY SAYS THAT $3,000 WAS FOR PAYING BILLS AND GROCERIES. SHE WAS SHARING EVERYTHING WITH RENTERS. SO WHAT ARE THE RULES WHEN IT COMES TO RENTING OUT YOUR APARTMENT HERE IN THE STATE OF NEW YORK? CBS 2 GOT SOME ANSWERS FROM THE RENT STABILIZATION ASSOCIATION AND WE LEARNED THOSE RULES ARE QUITE SPECIFIC. YOU CAN SUBLET YOUR APARTMENT ON A LONG-TERM BASIS BY GETTING THE LANDLORD’S APPROVAL. THAT’S OKAY. BUT TO RUN IT AS A HOTEL WHERE YOU’RE CHARGING RATES ON A NIGHTLY OR TRANSIENT BASIS? THAT IS NOT ALLOWED. Reporter: LIPITZ’S ATTORNEY, THIS DOESN’T WARRANT EVICTION. ERIN LOGAN, CBS 2 NEWS. WE DID PLACE MULTIPLE CALLS

Bless her heart. I wonder if she did a 1 shot deal through HRA? That usually helps with back rent.
