Fixture vs Personal Property

A fixture versus personal property in a
real estate transaction. That’s what we’re talking about today and we’re
getting started right now. Hi, I’m Stephanie Brannan. I’m a realtor here in
the Austin area and today we’re just gonna discuss really quickly what the
difference between a fixture and personal property is here in a real
estate transaction in the state of Texas. And we have a couple of guests that have
wandered onto the property here. I think they’re kinda cute. Life in Texas, you know. A fixture is something
that’s been legally attached to the property, such as decorations, equipment,
or even appliances. Fixtures are regarded as part of the property and it’s a given
though they will go with the buyer along with the rest of the property. One of the
most common questions I get asked by buyers is, “Does the refrigerator come with
the home?” Well, here in Texas a refrigerator is considered personal
property, however, sometimes the seller will include that with the sale of the
home. Just depends on their situation. And if they do decide after you go under
contract with them that they do want to sell it, they would
handle that as a non – realty item and they would sell it separately from the
real estate transaction. Best practices is, in the contract, the seller should be
specific about which items they wish to remove, or the buyer needs to be
specific about which items they wish that would remain. That way, if the seller
or buyer disagree about which item is a fixture or which is personalty, they
can at least agree that “this” remains or “this” goes. Well, I hope this was helpful
and if you ever have questions when you’re out looking at properties just
ask your agent, “Does this stay or does this go?”, and if they for some reason
don’t know (maybe it’s an unusual thing) they can always double check with the
listing agent and they can check with the seller. That way, we can always clear

We actually had a buyer want our staging curtains. They said it was part of the window treatments. Didn't bother to argue with them. If they needed my $30 worth of curtains.
